    O Chefe do Executivo manda publicar, nos termos da alínea 2) do artigo 5.º e do n.º 1 do artigo 6.º da Lei n.º 3/1999 da Região Administrativa Especial de Macau, o Acordo entre o Governo da Região Administrativa Especial de Macau da República Popular da China e o Governo da Federação Russa sobre a Dispensa Mútua de Vistos, nas suas versões autênticas nas línguas chinesa, russa e inglesa, acompanhado da respectiva tradução para a língua portuguesa.

    AGREEMENT
    between the Government of the Macao Special Administrative Region of the People’s Republic of China
    and the Government of the Russian Federation on Mutual Exemption of Visa Requirements

    The Government of the Macao Special Administrative Region of the People’s Republic of China duly authorized by the Central People’s Government of the People’s Republic of China to conclude this Agreement and the Government of the Russian Federation, hereinafter referred to as “the Parties”,

    Guided by desire to strengthen friendly relations and cooperation between the Macao Special Administrative Region of the People’s Republic of China and the Russian Federation,

    Willing to ease travel requirements for permanent residents of the Macao Special Administrative Region of the People’s Republic of China holding valid passport of the Macao Special Administrative Region of the People’s Republic of China (hereinafter referred as permanent residents of the Macao Special Administrative Region of the People’s Republic of China) and nationals of the Russian Federation,

    have agreed as follows:

    Article 1

    For the purpose of this Agreement the following definition applies:

    “Travel document”:

    for permanent residents of the Macao Special Administrative Region of the People’s Republic of China — valid passport of the Macao Special Administrative Region of the People’s Republic of China;

    for nationals of the Russian Federation — valid passport identifying a citizen of the Russian Federation abroad, diplomatic passport, service passport or seaman passport (seaman identity card) of the Russian Federation.

    Article 2

    1. Permanent residents of the Macao Special Administrative Region of the People’s Republic of China who hold travel documents and who do not intend to carry out any employment, study or take up residence in the territory of the Russian Federation shall be exempted from visa requirements for entry into, stay in, exit from or transit through the territory of the Russian Federation. The duration of each period of stay shall not exceed thirty (30) days.

    2. Nationals of the Russian Federation who hold travel documents and who do not intend to carry out any employment, study or take up residence in the territory of the Macao Special Administrative Region of the People’s Republic of China shall be exempted from visa requirements for entry into, stay in, exit from or transit through the territory of the Macao Special Administrative Region of the People’s Republic of China. The duration of each period of stay shall not exceed thirty (30) days.

    3. The aggregate period of stay permitted within any given period of time shall be determined according to the laws and regulations of each Contracting Party.

    Article 3

    1. Permanent residents of the Macao Special Administrative Region of the People’s Republic of China who hold travel documents and who intend to enter the territory of the Russian Federation for a period exceeding the term provided for in paragraph 1 of Article 2 of this Agreement are required to obtain a visa before entering the territory of the Russian Federation.

    2. Nationals of the Russian Federation who hold travel documents and who intend to enter the territory of the Macao Special Administrative Region of the People’s Republic of China for a period exceeding the term provided for in paragraph 2 of Article 2 of this Agreement are required to obtain a visa before entering the territory of the Macao Special Administrative Region of the People’s Republic of China.

    Article 4

    1. Permanent residents of the Macao Special Administrative Region of the People’s Republic of China who have lost their travel documents, or whose travel documents have been damaged while staying in the territory of the Russian Federation, shall immediately notify the competent authorities of the Russian Federation and the diplomatic mission or consular post of the People’s Republic of China in the Russian Federation.

    2. Permanent residents of the Macao Special Administrative Region of the People’s Republic of China who have lost their travel documents, or whose travel documents have been damaged while staying in the territory of the Russian Federation, shall be permitted to exit the territory of the Russian Federation and return to the Macao Special Administrative Region of the People’s Republic of China on the basis of temporary documents establishing identity and authorizing re-entry to the Macao Special Administrative Region of the People’s Republic of China issued by the diplomatic mission or consular post of the People’s Republic of China in the Russian Federation. Requisite permits from the competent authorities of the Russian Federation should also be obtained.

    3. Nationals of the Russian Federation who have lost their travel documents, or whose travel documents have been damaged while staying in the territory of the Macao Special Administrative Region of the People’s Republic of China, shall immediately notify the competent authorities of the Macao Special Administrative Region of the People’s Republic of China and the consular post of the Russian Federation in the Hong Kong Special Administrative Region of the People’s Republic of China.

    4. Nationals of the Russian Federation who have lost their travel documents, or whose travel documents have been damaged while staying in the territory of the Macao Special Administrative Region of the People’s Republic of China, shall be permitted to exit the territory of the Macao Special Administrative Region of the People’s Republic of China and return to the Russian Federation on the basis of temporary documents establishing identity and authorizing re-entry to the Russian Federation issued by the consular post of the Russian Federation in the Hong Kong Special Administrative Region of the People’s Republic of China. Requisite permits from the competent authorities of the Macao Special Administrative Region of the People’s Republic of China should also be obtained.

    Article 5

    Persons mentioned in Article 2 and Article 3 of this Agreement shall cross the border of the Russian Federation or the boundary of the Macao Special Administrative Region of the People’s Republic of China through the crossing points open to international passenger traffic.

    Article 6

    1. Permanent residents of the Macao Special Administrative Region of the People’s Republic of China who hold travel documents and who are unable to leave the territory of the Russian Federation within the period specified in paragraph 1 of Article 2 of this Agreement due to reasons of force majeure which is supported by documentary or any other reliable confirmation may be permitted, upon application, to stay in the territory of the Russian Federation for an appropriate period necessary for their return to the Macao Special Administrative Region of the People’s Republic of China. Such extension of stay shall be granted without any charge to the applicant.

    2. Nationals of the Russian Federation who hold travel documents and who are unable to leave the territory of the Macao Special Administrative Region of the People’s Republic of China within the period specified in paragraph 2 of Article 2 of this Agreement due to reasons of force majeure which is supported by documentary or any other reliable confirmation may be permitted, upon application, to stay in the territory of the Macao Special Administrative Region of the People’s Republic of China for an appropriate period necessary for their return to the Russian Federation. Such extension of stay shall be granted without any charge to the applicant.

    Article 7

    1. The competent authorities of the Macao Special Administrative Region of the People’s Republic of China reserve the right to deny entry to or curtail stay in the territory of the Macao Special Administrative Region of the People’s Republic of China of nationals of the Russian Federation it considers undesirable.

    2. The competent authorities of the Russian Federation reserve the right to deny entry to or curtail stay in the territory of the Russian Federation of permanent residents of the Macao Special Administrative Region of the People’s Republic of China it considers undesirable.

    Article 8

    1. Permanent residents of the Macao Special Administrative Region of the People’s Republic of China during their stay in the territory of the Russian Federation shall be obliged to abide by the laws and regulations in force in the territory of the Russian Federation.

    2. Nationals of the Russian Federation during their stay in the territory of the Macao Special Administrative Region of the People’s Republic of China shall be obliged to abide by the laws and regulations in force in the territory of the Macao Special Administrative Region of the People’s Republic of China.

    Article 9

    1. Each Party may suspend in whole or in part the application of this Agreement for reasons of public order, protection of public security or protection of public health. The decision on suspension shall be communicated in writing to the other Party not later than seventy-two (72) hours before its entry into force.

    2. The Party that has taken a decision to adopt measures stipulated in paragraph 1 of this Article shall immediately notify the other Party in writing once such measures no longer apply and about the resumption of this Agreement.

    Article 10

    1. Competent authorities of the Parties shall exchange specimens of travel documents not later than thirty (30) days after this Agreement is signed.

    2. Competent authorities of the Parties shall inform each other of any modification with regard to travel documents at least thirty (30) days in advance of the introduction of these changes and in parallel provide the competent authorities of the other Party with specimens of these travel documents.

    3. Competent authorities of the Parties shall exchange information relating to temporary documents referred to in Article 4 of this Agreement.

    Article 11

    Any dispute between the Parties concerning the interpretation or application of this Agreement shall be settled through consultations and negotiations between the Parties.

    Article 12

    1. By mutual consent of the Parties this Agreement may be amended or supplemented.

    2. Agreed amendments or additions shall enter into force by the same procedures provided for in paragraph 1 of Article 13 of this Agreement.

    Article 13

    1. This Agreement shall enter into force thirty (30) days from the date of receipt of the last written notification of the completion by the Parties of their domestic procedures necessary for its entry into force.

    2. This Agreement shall remain in force for an indefinite period of time. Either Party may terminate this Agreement by notifying the other Party in writing. This Agreement shall terminate upon the expiry of sixty (60) days after the date of receipt of such notification by the other Party.

    Done at Macao on 19 June 2012 in two originals, each in the Chinese, Russian and English languages, all texts being equally authentic. In case of any divergence of interpretation, the English text shall be used.

      FOR THE GOVERNMENT OF THE RUSSIAN FEDERATION

    Acordo entre o Governo da Região Administrativa Especial de Macau da República Popular
    da China e o Governo da Federação Russa sobre a Dispensa Mútua de Vistos

    O Governo da Região Administrativa Especial de Macau da República Popular da China (RAEM), devidamente autorizado a celebrar o presente Acordo pelo Governo Popular Central da República Popular da China, e

    O Governo da Federação Russa

    a seguir denominados por «Partes»

    Com o objectivo de fortalecer os laços de amizade e cooperação entre a RAEM e a Federação Russa, e de facilitar as formalidades turísticas dos residentes permanentes da RAEM, titulares do passaporte da RAEM e dos nacionais da Federação Russa,

    Acordam no seguinte:

    Artigo 1.º

    Para efeitos do presente Acordo, entende-se por:

    «Documentos de viagem»

    Para os residentes permanentes da RAEM — os passaportes válidos da RAEM.

    Para os nacionais da Federação Russa — os passaportes comuns, diplomáticos, de serviços ou passaportes marítimos (cédula de identidade marítima) válidos da Federação Russa;

    Artigo 2.º

    1. Os residentes permanentes da RAEM, titulares de documentos de viagem válidos, ficam isentos de vistos para entrada, permanência, saída ou trânsito na Federação Russa, com fins que não sejam de emprego, estudo ou de residência. O tempo de limite para cada estadia é até 30 (trinta) dias.

    2. Os nacionais da Federação Russa, titulares de documentos de viagem válidos, ficam isentos de visto para entrada, permanência, saída ou trânsito na RAEM, com fins que não sejam de emprego, estudo, ou de residência. O tempo de limite para cada estadia é até 30 dias.

    3. O período total de permanência permitido em qualquer período de tempo deve ser determinado de acordo com a legislação e regulamento de cada uma das Partes.

    Artigo 3.º

    1. Os residentes permanentes da RAEM, titulares de documentos de viagem válidos que desejem permanecer na Federação Russa por período superior ao previsto no n.º 1 do artigo 2.º do presente Acordo, carecem de obter previamente o visto antes da sua entrada na Federação Russa.

    2. Os nacionais da Federação Russa, titulares de documentos de viagem válidos que desejem permanecer na RAEM por período superior ao previsto no n.º 2 do artigo 2.º do presente Acordo, carecem de obter previamente o visto antes da sua entrada na RAEM.

    Artigo 4.º

    1. Em caso de extravio ou destruição de documentos de viagem durante a estadia na Federação Russa, os residentes permanentes da RAEM devem comunicar imediatamente o facto às autoridades competentes da Federação Russa e às missões diplomáticas ou consulares da República Popular da China acreditadas na Federação Russa.

    2. Aos residentes permanentes da RAEM, que tenham extraviado ou destruído o seu documento de viagem durante a sua estadia na Federação Russa, são permitidos a sair da Federação Russa e regressar à RAEM, desde que obtenha o documento de identificação provisório e a autorização de regresso à RAEM, emitidos por missões diplomáticas ou consulares da República Popular da China acreditadas na Federação Russa, e a autorização necessária emitida pelas autoridades competentes da Federação Russa.

    3. Em caso de extravio ou destruição de documentos de viagem durante a estadia na RAEM, os nacionais da Federação Russa devem comunicar imediatamente o facto às autoridades competentes da RAEM e ao consulado russo acreditado na Região Administrativa Especial de Hong Kong da República Popular da China.

    4. Aos nacionais da Federação Russa, que tenham extraviado ou destruído o seu documento de viagem durante a sua estadia na RAEM, são permitidos a sair da RAEM e regressar à Federação Russa, desde que obtenha o documento de identificação provisório e a autorização de regresso à Federação Russa emitidos pelo consulado russo acreditado na Região Administrativa Especial de Hong Kong da República Popular da China, e a autorização necessária emitida pelas autoridades competentes da RAEM.

    Artigo 5.º

    As pessoas referidas nos artigos 2.º e 3.º do presente Acordo devem entrar e sair da Federação Russa e da RAEM, através dos postos de migração próprios para a passagem de visitantes internacionais.

    Artigo 6.º

    1. Em casos de comprovada, por documento ou por outra confirmação, a impossibilidade de sair da Federação Russa por motivo de força maior no prazo definido no n.º 1 do artigo 2.º, pode ser concedida a prorrogação do prazo de permanência aos residentes permanentes da RAEM, titulares de documentos de viagem válidos, por um período adequado para o seu regresso à RAEM, mediante requerimento. Pela concessão da prorrogação do prazo de permanência acima referida não é devida qualquer taxa.

    2. Em casos de comprovada, por documento ou por outra confirmação, a impossibilidade de sair da RAEM por motivo de força maior, no prazo definido no n.º 2 do artigo 2.º, pode ser concedida a prorrogação do prazo de permanência aos nacionais da Federação Russa, titulares de documentos de viagem válidos, por um período adequado para o seu regresso à Federação Russa, mediante requerimento. Pela concessão da prorrogação do prazo de permanência acima referida não é devida qualquer taxa.

    Artigo 7.º

    1. As autoridades competentes da RAEM reservam o direito de recusar a entrada de nacionais da Federação Russa que sejam consideradas indesejáveis e de encurtar o prazo de permanência.

    2. As autoridades competentes da Federação Russa reservam o direito de recusar a entrada de residentes permanentes da RAEM que sejam consideradas indesejáveis e de encurtar o prazo de permanência.

    Artigo 8.º

    1. Os residentes permanentes da RAEM, durante a sua permanência na Federação Russa, estão sujeitos à observância das leis e regulamentos vigentes da Federação Russa.

    2. Os nacionais da Federação Russa, durante a sua permanência na RAEM, estão sujeitos à observância das leis e regulamentos vigentes da RAEM.

    Artigo 9.º

    1. Por razões de ordem pública, protecção da segurança ou saúde públicas, qualquer uma das Partes pode suspender, total ou parcialmente, a aplicação do presente Acordo. Tal suspensão deve ser notificada à outra Parte, por escrito e com uma antecedência mínima de 72 (setenta e duas) horas.

    2. Em caso de cancelamento da suspensão, a Parte que tomou a decisão de adoptar as medidas previstas no n.º 1 deste artigo, deve notificar imediatamente, por escrito, a outra Parte da retomada da aplicação do presente Acordo.

    Artigo 10.º

    1. As autoridades competentes das Partes trocarão exemplares dos seus documentos de viagem, no prazo de 30 (trinta) dias, contados da data da celebração do presente acordo.

    2. As autoridades competentes das Partes devem notificar, por escrito, a outra Parte, sempre que se verifique a adopção de um novo modelo de documentos de viagem, e enviar o exemplar desses novos documentos às autoridades competentes da outra Parte, pelo menos com uma antecedência de 30 (trinta) dias que precedem a entrada da circulação dos mesmos.

    3. As autoridades competentes das Partes devem proceder à comunicação mútua em relação às informações sobre os documentos provisórios previstos no artigo 4.º

    Artigo 11.º

    Todos os litígios decorrentes da interpretação e execução do presente Acordo serão resolvidos por acordo e troca de opiniões entre as autoridades competentes das Partes contratantes.

    Artigo 12.º

    1. No presente Acordo, podem introduzir-se alterações ou aditamento por consentimento de ambas as Partes.

    2. As alterações e aditamento aprovados entrarão em vigor, de acordo com os procedimentos previstos nos termos do n.º 1 do artigo 13.º do presente Acordo.

    Artigo 13.º

    1. O presente Acordo entra em vigor 30 (trinta) dias após a data de recepção da última notificação escrita da conclusão dos procedimentos necessários para a entrada em vigor do presente Acordo, procedidos por cada uma das Partes.

    2. O presente Acordo tem vigência ilimitada e pode ser denunciado por qualquer das Partes mediante notificação escrita dirigida a outra Parte. O presente Acordo terminará 60 (sessenta) dias após a data de recepção da notificação por outra Parte.

    Feito em Macau, em 19 de Junho de 2012, em dois exemplares, nas línguas chinesa, russa e inglesa, fazendo todos os textos igualmente fé. Em caso de divergência na interpretação, prevalecerá o texto em inglês.
